These Terms of Service (“Terms”) govern your use of the SwimAI mobile application and the website at montdo.com.

SwimAI is operated by Conrad Addo, based in Spain (“SwimAI”, “we”, “us”). Contact: conrad@montdo.com.

By downloading, accessing, or using SwimAI, you agree to these Terms. If you do not agree, do not use SwimAI.

1. The SwimAI service

SwimAI provides live swimming technique practice coaching on iPhone using the device camera (“Practice”), session results, and optional account features to save progress. SwimAI Pro is an optional subscription for ongoing Practice access after a short guest trial.

In the current App Store version (V1), cloud video analysis (“Analyze”) is not available. Product features may change over time.

SwimAI provides coaching guidance for swimming practice. It is not a medical device, medical service, or substitute for professional coaching or medical advice. Practice safely in a suitable environment and stop if you feel pain or discomfort.

2. Eligibility and audience

SwimAI is a general-audience swimming app. It is kid-friendly and children may use it, but it is not specifically directed at children and is not offered as an Apple Kids Category / Made for Kids product. If you allow a child to use SwimAI, you are responsible for their use and for complying with any rules that apply to you.

3. Accounts

You may use Practice as a guest for a limited number of completed sessions (currently up to three). After that, SwimAI may require an account to continue. Accounts may be created with email/password, Sign in with Apple, or Google Sign-In where available.

You are responsible for maintaining the security of your account credentials and for activity under your account. Provide accurate information and notify us if you believe your account has been compromised.

You may delete your account in the app when the deletion feature is available. Deleting your SwimAI account does not automatically cancel an Apple subscription.

5. Subscriptions and in-app purchases

SwimAI Pro is offered as an auto-renewable subscription through the Apple App Store. Product identifiers currently include monthly and annual SwimAI Pro subscriptions. Pricing is shown in the App Store / purchase sheet for your storefront and may include an introductory offer (such as a free trial) when available.

Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. Manage or cancel subscriptions in your Apple ID subscription settings. Deleting the app or your SwimAI account does not cancel a subscription by itself.

You can restore previous purchases from SwimAI’s account/settings flows using Restore Purchases, which uses Apple’s restore mechanisms via Superwall/StoreKit.

Refund requests for App Store purchases are handled by Apple under Apple’s refund policies. Contact Apple Support or use Apple’s report a problem tools for billing disputes related to Apple charges.

6. Intellectual property

SwimAI, including its software, design, text, graphics, and branding, is owned by Conrad Addo or its licensors and is protected by intellectual property laws. These Terms do not transfer ownership of any SwimAI intellectual property to you. You may not copy, modify, distribute, or create derivative works from SwimAI except as expressly allowed by law or with our prior written permission.

7. Your data and privacy

Our collection and use of personal information is described in the Privacy Policy. By using SwimAI, you also acknowledge that policy.

8. Availability and changes

We aim to keep SwimAI available and useful, but we do not guarantee uninterrupted or error-free operation. Features may be added, changed, or removed. We may update these Terms; the updated Terms will be posted on this page with a revised date. Continued use after changes become effective constitutes acceptance of the updated Terms, except where applicable law requires otherwise.

9. Disclaimers

SwimAI is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. Coaching feedback is informational and may be incomplete or inaccurate. You remain responsible for how you practice and for your own safety.

10. Limitation of liability

To the fullest extent permitted by applicable law, Conrad Addo and SwimAI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of SwimAI.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to SwimAI or these Terms is limited to the greater of (a) the amounts you paid to us for SwimAI Pro in the twelve (12) months before the claim, or (b) fifty euros (€50). Nothing in these Terms limits liability that cannot be limited under Spanish or other applicable mandatory law (including liability for willful misconduct or death or personal injury caused by negligence where such limitation is prohibited).

11. Governing law

These Terms are governed by the laws of Spain, without regard to conflict-of-law rules. Courts in Spain will have jurisdiction, without prejudice to any mandatory consumer protections that apply to you in your country of residence.
